Terms of Service

1. What HPT is

Hoffman Property Technologies ("HPT," "we," or "us") operates a technology platform and marketplace that connects property managers and property owners with independent service professionals for property services in North Carolina. HPT provides the platform, coordination, documentation and recordkeeping.

2. Independent service professionals

Service professionals who accept work through HPT are independently operated businesses engaged as independent contractors. They are not employees, agents or joint employees of HPT, and they are responsible for their own personnel, equipment, taxes, licensing and insurance. HPT requires a signed independent contractor agreement, a W-9, photo identification, and active workers' compensation and general liability insurance as a condition of engagement. Approval is required and is never automatic.

3. HPT is not a general contractor

HPT does not act as a general contractor and does not perform, supervise or hold itself out as performing work that requires a general contractor license. HPT does not accept work outside the scope its platform coordinates, and nothing in these terms creates a construction, design or general contracting relationship with HPT.

4. Accounts, roles and organizations

Access to the HPT operations platform is granted by organization and role. You are responsible for keeping your credentials secure, for the accuracy of information you submit, and for activity carried out under your account. HPT may suspend or remove access to protect the platform, its users or its records.

5. Work orders, scope and approvals

Work is coordinated through HPT work orders. Scope, schedule, amendments, change orders, inspections and approvals are recorded in the platform, and those records govern what was authorized and what was delivered. Descriptions of services on our public pages are descriptive and are not warranties or guarantees of a specific outcome.

6. Fees and payment

Fees, invoicing and settlement terms are established in your organization's written agreement with HPT and in the records produced by the platform. Payment features are enabled only where HPT has authorized them; where they are unavailable, the platform will state so.

7. Communications and consent

Security, account and transactional notices are part of operating your account. Optional marketing email and optional marketing text messages require your separate, affirmative consent and can be withdrawn at any time from your communication preferences. 8. Acceptable use

You may not misuse the platform, interfere with its security, attempt to access data belonging to another organization, scrape or resell platform data, or use HPT to violate law or the rights of others.

9. Intellectual property

HPT and its licensors retain all rights in the platform, its software, and its documentation. You retain rights in the content and records you submit, and you grant HPT the rights needed to operate, document and support the services.

10. Disclaimers and limitation of liability

Except where prohibited by law, the platform is provided as is, and HPT disclaims implied warranties. HPT is not liable for indirect, incidental, special or consequential damages. Nothing here limits liability that cannot be limited under applicable law.

11. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules.

12. Changes to these terms

We may update these terms as HPT changes. Each version carries the version number, effective date and reference identifier shown at the top of this page, and material changes will be accompanied by additional notice where appropriate. Continued use after a new effective date means you accept the updated terms.
